The Trump administration has proclaimed that “congestion pricing is dead”, but the toll remains in place as the battle over NYC’s streets moves to the courts.

The latest development in the New York City congestion pricing saga comes as the Trump administration revokes federal approval for the tolling program. This move is yet another roadblock for the controversial toll, but congestion pricing remains in effect for the time being. Here’s an update on congestion pricing in NYC so you’re all caught up on what’s happening in the streets.

Congestion pricing was introduced on January 5th and charges drivers $9 when entering Manhattan between Central Park and Battery Park during peak traffic hours. The goal of the toll is to reduce traffic, improve city air quality, and raise funds for the Metro Transit Authority (MTA). As I mentioned in my recent article about NYC’s congestion pricing, the policy is essentially a way to make NYC drivers subsidize public transit and repair an ailing subway system.

Trump administration revokes approval

President Trump hasn’t hidden his distaste for congestion pricing and has frequently criticized the policy for being a burden on working-class drivers and raising funds for public transit instead of roads. A few weeks ago, Trump revealed more plans to remove the toll just as initial polling data and traffic results of the policy began to emerge. On February 19th, the Trump administration followed through on those plans by revoking federal approval for New York City’s congestion pricing.

NY and the MTA fight back

Governor Kathy Hochul and the Metro Transit Authority responded immediately, making clear their intention to keep congestion pricing in place. The MTA has filed a federal lawsuit to challenge the order.

President Trump posted this message on social media on Wednesday: “CONGESTION PRICING IS DEAD. Manhattan, and all of New York, is SAVED. LONG LIVE THE KING! In response, Gov. Hochul stated, “We are a nation of laws, not ruled by a king. We’ll see you in court.”

Is congestion pricing dead?

Not yet— the city’s congestion pricing will continue despite the federal order from President Trump and Secretary Duffy of the Department of Transportation. The revoking of federal approval for such a large transportation project is unprecedented and legal scholars are questioning the legality of Secretary Duffy’s order to end the toll. Now begins a legal battle that will take many months or even years and, in the meantime, drivers will still be on the hook for the $9 traffic surcharge.

Positive initial results

Recently published data has indicated positive initial results as the policy gradually grows in popularity among New Yorkers. Polls of commuters and residents revealed an uptick in approval of the program compared to polling numbers in December before congestion pricing took effect. Commuters reported lower traffic and faster commutes— and these less congested roads mean other forms of transportation like buses, bicycles, and electric bikes can flow better throughout the city.
