Maintenance, Repair, Damage, Storage and Theft Policies
Maintenance and Repair Responsibility
Routine maintenance costs are included in your Subscription. Upway shall contact you to schedule service approximately every six (6) months and you are responsible for ensuring the E-Bike is brought to the Upway Redondo Beach location for required service.
If the E-Bike requires repair due to a mechanical breakdown, Upway will arrange the fix. You shall not repair or cause any third party to repair the E-Bike or equipment. You shall be responsible for the costs of any repairs resulting from your misuse or negligence.
Damage Notification
You shall notify Upway promptly, and in any event within twenty-four (24) hours, of any damage, malfunction, or necessary repair.
Theft or Loss Notification
In the event the E-Bike is stolen or lost, you must comply with the notification and procedural requirements set forth in this section. Failure to comply with these requirements may result in the loss of any applicable liability limitation.
If the E-Bike is stolen or lost, you must: (a) notify Upway immediately, and in any event within twenty-four (24) hours of discovering the theft or loss; (b) report the theft or loss to the police within twenty-four (24) hours; (c) provide Upway with a written copy of the police report; and (d) return all original keys, the charger, and the chain lock to Upway within five (5) business days of the theft or loss, unless otherwise directed by Upway.
Storage and Locking Requirements
The E-Bike must be stored safely and legally overnight on private property at the Primary Storage Location set forth in the Order. Customer must secure the E-Bike at all times when it is unattended by using a chain lock fastened to a fixed, immovable object (e.g., a bolted-down bike rack or tall, sturdy sign pole). Failure to securely lock the E-Bike as set forth hereunder is a breach of the Service Terms, and will result in the loss of the liability limitation protection under the Indemnification clause of the Service Terms.
Delivery and Return of E-Bike
At the conclusion of the Subscription Term, you shall return the E-Bike, keys, charger, lock, and accessories to the designated Upway location (or via paid pick-up described in the Pricing Page) within two (2) business days.
Upway will inspect the E-Bike and equipment upon return. Upway reserves the right to charge your Payment Method (as defined in Service Terms) for the amount of any damages or missing items identified within sixty (60) days of the return.
Capitalized terms used but not defined have the meanings given to them in the Upway Terms of Use.
